Possibly, but the answer depends on the applicable housing agreement, legislation and later documents. An apartment described as edilizia convenzionata may involve restrictions affecting price, purchaser eligibility, letting or resale. Those restrictions are not identical for every property. Before offering, establish which remain effective and whether your purchase and intended use comply with them.
| What you encounter | Document to request | What could go wrong | Before the offer |
|---|---|---|---|
| Reference to a municipal convention | Complete agreement, attachments and amendments | A relevant condition is omitted from the seller’s summary | Reconstruct the applicable position |
| A maximum sale price | Applicable calculation or official determination | The asking price is treated as unrestricted without support | Establish the lawful pricing basis |
| Purchaser requirements | Applicable provisions and required evidence | The proposed buyer does not meet a condition still in force | Check eligibility before committing |
| “Affrancazione completed” | Final instrument and relevant records | Removal of one restriction is mistaken for removal of all restrictions | Verify precisely what changed |
What does “edilizia convenzionata” mean?
Edilizia convenzionata describes housing developed under an agreement with a public authority, usually the municipality.
The arrangement may involve benefits or concessions associated with the development, together with obligations governing the homes.
A convenzione, the governing agreement, can therefore matter when the apartment is sold again. The latest seller’s deed may refer to it without reproducing its full terms.
You may also encounter PEEP, short for Piano per l’Edilizia Economica e Popolare, a plan associated with a particular housing framework.
These labels identify questions to investigate. They do not, by themselves, establish the precise restrictions applying today.
Do not equate every convention with public rental housing, a ban on foreign purchasers or a permanent prohibition on resale.
Full ownership does not answer every question
Two separate matters require assessment:
- What right is being transferred?
- Which obligations or restrictions affect the transaction and later use?
An apartment may be held in full ownership and still require examination of a convention. Conversely, a surface-right property should not automatically be assumed to carry every possible housing restriction.
The right to the building and land must be reviewed, but it is not the subject of this article. Here, the focus is whether the proposed acquisition, price and use fit the applicable arrangement.
The seller’s statement that “you will be the owner” does not resolve those questions.
Start with the complete document history
Request the original convention and the instruments that may have changed it.
Relevant material can include:
- The original agreement and attachments.
- Amendments or replacement conventions.
- The seller’s acquisition deed and relevant earlier titles.
- Documents concerning transformation or removal of restrictions.
- Official correspondence or determinations.
- Evidence of any procedure still pending.
Build a sequence of what happened and when. Different obligations may have different starting points, durations or routes to removal.
An older building is not automatically free of restrictions. Nor does a previous sale establish that every current requirement was resolved.
For the broader purchase file, see What Documents Should You Ask for Before Buying Property in Italy?.
Is the asking price permitted?
Where a prezzo massimo di cessione, a maximum sale price, remains applicable, the transaction needs a defensible pricing basis.
Ask:
- Which restriction applies to this unit?
- What calculation or determination is required?
- Which accessories are included?
- Is the available assessment current and relevant to this sale?
- What evidence supports a claim that the restriction has ended?
Do not assume that an agreed market price overrides a binding limit.
Likewise, a separate amount attributed to furniture or another item should not be used to conceal part of the property price. Any genuine separate transaction requires its own accurate documentation.
If the seller proposes removing the restriction before completion, assess that procedure and the contractual consequences before treating the price as unrestricted.
Can this particular buyer acquire the apartment?
General eligibility to buy Italian property is not the same as satisfying any purchaser requirements under a housing arrangement.
Establish whether requirements remain effective, to whom they apply and what evidence is needed. Some transactions may require an assessment or confirmation through the relevant municipal process.
For a foreign buyer, this should be investigated early rather than assumed from either nationality or non-residence.
Do not automatically conclude that a foreign purchaser is excluded. Do not automatically conclude that the convention is irrelevant because the buyer can otherwise own Italian property.
Confirm the proposed purchaser before the offer is prepared. Substituting a relative or company later may not resolve the issue and can create further legal and tax questions.
Can you use it as a holiday home or rent it out?
State the intended use clearly.
A purchase for permanent occupation, occasional family visits, long-term letting or tourist accommodation may raise different questions.
Review whether the applicable documents and rules impose relevant conditions concerning:
- Occupation or residential use.
- Letting and any rent limits.
- The person entitled to occupy.
- Later transfer.
- Steps required before a change in arrangements.
These are matters to check, not a list of restrictions present in every convention.
An existing rental activity does not settle whether your proposed use is permissible. Separate convention-based conditions from planning, condominium, administrative and tax requirements.
Have the restrictions expired?
A claim that “the convention expired” needs a legal and documentary basis.
Identify the relevant provision, starting date, duration and effect of later instruments or legislation. Then distinguish the particular restriction from the rest of the arrangement.
Avoid shortcuts such as:
- “The building is over twenty years old.”
- “The first owner already sold.”
- “The land is now privately owned.”
- “The municipality has not objected.”
Each statement may be relevant, but none supplies a universal answer.
For some historical arrangements, interpretation can require particular care. If the position is uncertain, that uncertainty should be explained before it becomes the basis of an unconditional purchase.
What does “affrancazione” actually remove?
In this context, affrancazione commonly refers to removal of specified restrictions, particularly those concerning maximum sale price or rent.
It should not be understood as a promise that every obligation disappears.
Trasformazione, changing a surface-right position into ownership of the land, is a different operation. Even where procedures are coordinated, their effects must be distinguished.
| Status reported by the seller | What still needs checking |
|---|---|
| Application submitted | Eligibility, outstanding steps and expected legal result |
| Amount calculated | What the calculation covers and what remains to be completed |
| Payment made | Whether payment alone produces the claimed effect |
| Instrument executed | The unit covered, restrictions removed and any conditions remaining |
A pending application is not a completed release.
What should the offer address?
If the purchase depends on an eligibility assessment, permitted price or removal of a restriction, the agreement should address that requirement before signature.
Depending on the findings, relevant terms may include:
- Delivery of the complete convention history.
- A defined assessment of the purchaser’s position.
- The pricing basis and relevant supporting evidence.
- Confirmation of compatibility with the intended use.
- A specific restriction-removal result, where required.
- Responsibility for costs and procedural steps.
- Realistic deadlines.
- Consequences if the required result is not achieved.
- Custody, release and repayment of initial payments.
“Subject to affrancazione” leaves important questions unanswered. Which restriction must be removed, through what completed result, and by when?
A caparra confirmatoria, a contractual deposit with specific consequences on default, must be considered alongside those conditions. Read Caparra vs Deposit When Buying Property in Italy.
If you have already signed, obtain advice before assuming that discovery of a convention creates a right to withdraw.
An illustrative purchase in Milan
A couple from Amsterdam finds an apartment in Milan for occasional visits and possible letting.
The seller explains that a price restriction has ended. The draft offer describes the property and price but does not address the convention or the buyers’ intended use.
The review identifies a separate purchaser requirement in the available documents. Whether it remains applicable and whether the buyers satisfy it require assessment.
Before signing, they obtain the relevant records and clarification. The proposed terms then reflect the outcome, any outstanding requirement, the timetable and payment consequences.
The couple does not treat the end of one restriction as proof that every aspect of the purchase is unrestricted.
This is a hypothetical example, not a client case.
Send these six document groups before offering
- The listing and complete draft offer.
- The seller’s deed and relevant earlier titles.
- The original convention, attachments and amendments.
- Available price calculations or official determinations.
- Any restriction-removal, transformation or pending-application documents.
- Your purchaser details, intended use, funding requirements and deadline.
Identify which claim you need verified: permitted sale price, eligibility, use, expiry or completed removal.
How Govoni Law helps
For more than 16 years, our lawyers have assisted foreign property buyers throughout Italy. We act only on the buyer’s side.
We can review the convention history, assess the relevant legal questions and explain how findings affect the proposed purchase. Coordination with the appointed notary, municipal offices and technical professionals is defined within the engagement.
- Before You Sign Brief: initial orientation and identification of further work. It does not establish that the convention’s restrictions have ended.
- Light Due Diligence: substantive review of a genuinely defined legal area.
- Full Legal Due Diligence: wider investigation where convention, title, property and contract issues interact.
Drafting, negotiation and additional procedures must be expressly agreed.
We do not sell or find property, provide tax advice, arrange mortgages, perform technical surveys or obtain visas. We do not guarantee release from restrictions, regularisation or authorisations.
Frequently asked questions
Is every convenzionata apartment subject to the same restrictions?
No. The legal framework, convention, later instruments and relevant dates must be assessed.
Can an apartment in full ownership still have restrictions?
Yes. Ownership and convention-based obligations are separate questions.
Can a foreign non-resident buy?
Do not assume either eligibility or exclusion. Assess the proposed buyer against any requirements actually applicable to the property.
Does the passage of twenty years remove everything?
Not as a universal rule. Identify the relevant obligation and legal basis for its alleged expiry.
Is affrancazione the same as acquiring the land?
No. Removal of specified restrictions and transformation of the surface right are distinct operations.
Can I rely on an application already submitted?
Not as proof of a completed result. Establish what remains outstanding and address any essential outcome in the agreement.
Can I use the apartment for holiday lets?
That requires assessment of the convention and the other rules relevant to the intended activity. Ownership alone does not establish permission.
If your Italian apartment documents mention edilizia convenzionata, PEEP, a maximum price or affrancazione, send Govoni Law the convention, seller’s deed, supporting records and draft offer before signing or paying. Explain who will buy and how the apartment will be used.
We will do our best to reply to your request as soon as possible.
