“Livello” or “Enfiteusi” in an Italian Property Deed: What Should Buyers Check Before Offering?

Do not assume that an old reference is either harmless or proof that the seller cannot sell. “Livello” can describe different historical arrangements, while enfiteusi is a distinct property right. Before offering, establish the right actually held, any continuing obligations and the evidence supporting a claimed release. A cadastral entry or the seller’s explanation alone does not resolve the position.

What do these words mean?

Start by identifying where the terminology appears: a current cadastral extract, historical record, acquisition deed or earlier instrument.

TermInitial meaning to investigate
LivelloA historical arrangement or burden whose legal nature needs classification
LivellarioThe person identified as holding the beneficiary’s position under that arrangement
EnfiteusiA real right giving extensive enjoyment of property owned by another
EnfiteutaThe holder of that right
ConcedenteThe grantor or holder of the corresponding ownership position, according to the arrangement
Canone enfiteuticoThe periodic payment associated with enfiteusi

These explanations help you recognise the issue. They do not replace examination of the instrument and subsequent history.

The same word in two properties’ records does not establish that both require the same solution.

Is the seller the full owner?

That is the question to investigate, not the conclusion to assume.

Where the position is genuinely enfiteusi, the holder has a real right over property that remains owned by the grantor. The holder’s position should not be described simply as ordinary full ownership.

However, a historical reference to livello may require a different classification. There may also have been a valid later event changing or extinguishing the relevant rights.

Separate three questions:

  • What relationship originally existed?
  • What has happened since?
  • What right can the seller transfer today?

A property may have been occupied, inherited, improved and marketed as a family home for many years without those facts alone answering the title question.

Is it just an old entry in the Catasto?

It may be outdated, but that needs evidence.

A visura catastale, a cadastral extract, can alert you to a historical relationship. It is not a substitute for the underlying title investigation.

Equally, the absence of the wording from a newer extract does not, by itself, establish that the relationship was legally extinguished.

Compare the records with:

  • The instrument establishing the arrangement, where available.
  • Relevant acquisition and recognition documents.
  • Later transfers and changes.
  • Land-register records.
  • Any valid release, redemption or statutory basis for extinction.

A correction to a record and the legal event justifying that correction are different matters.

If the records disagree, investigate the reason rather than selecting the version that best matches the listing.

What obligations could still matter?

For enfiteusi, the Civil Code identifies obligations to improve the property and pay a periodic canone.

For a particular historical arrangement, assess its nature, governing documents, applicable law and any later changes before determining what remains effective.

Relevant questions include:

  • Who is entitled to the payment?
  • What is the basis for its amount?
  • Are there demands or unresolved arrears?
  • Are other obligations recorded?
  • Does the arrangement affect the proposed acquisition or intended use?

The amount of the annual payment is not the only issue. A modest canone does not establish that the underlying title position is insignificant.

Where the claimant is a municipality, public body or ecclesiastical entity, identify the correct party and the applicable framework. Do not assume every institution follows the same procedure.

Does decades of non-payment mean the right disappeared?

Not by itself.

The continuing legal relationship and individual unpaid instalments require separate analysis. Questions about limitation of a particular payment do not automatically answer whether the underlying right still exists.

Likewise, long occupation does not automatically convert a holder’s existing right into full ownership.

If the seller relies on possession or a claimed legal extinction, ask for the precise basis and supporting material. Do not accept “nobody has asked for money” as the complete title explanation.

This article concerns preparation for purchase, not a guide to proving ownership through litigation.

What proves that affrancazione has occurred?

In the context of enfiteusi, affrancazione is redemption through the applicable legal mechanism, leading to consolidation of full ownership.

The word also appears in other property contexts with different effects. Removing a housing price restriction is not the same operation as redeeming enfiteusi.

Where the seller says the property has been affrancated, establish:

  • Which relationship was addressed.
  • Who participated or issued the relevant instrument.
  • Which parcels or units were covered.
  • What legal result was achieved.
  • Whether the relevant registration and record updates support that result.
  • Whether any matter remains outstanding.

A request, quotation or payment receipt should not automatically be treated as proof of the completed legal event.

Where extinction is said to follow from legislation rather than a redemption instrument, assess that basis and how it applies to the property.

Does the issue affect every part of the purchase?

Not necessarily.

A house with land may comprise several parcels with different histories. An old reference may relate to one field, an access strip or land later reorganised into other identifiers.

Trace the affected property through the records.

A technician may be needed to connect historical parcels with the present configuration. Legal analysis establishes the rights and consequences; technical identification establishes which land the documents concern.

Do not assume that a release relating to one parcel clears every part of the property. Nor should a reference affecting one parcel automatically be treated as affecting the whole acquisition.

What should the offer address?

The offer should reflect the right that can actually be transferred and any result essential to the buyer.

Depending on the findings, relevant terms may include:

  • Precise identification of the affected property.
  • The right the seller represents they will transfer.
  • Delivery of specified title and historical documents.
  • A defined legal assessment.
  • Any technical identification required.
  • A particular release or other result needed before completion.
  • Responsibility for procedures, costs and identified amounts.
  • Realistic deadlines.
  • Consequences if the required result is not achieved.
  • Custody, release and repayment of initial payments.

Avoid a vague promise to “remove the old entry before the deed”. It may address a record without defining the legal position that must be established.

A caparra confirmatoria, a contractual deposit with specific consequences on default, needs assessment alongside those terms. See Caparra vs Deposit When Buying Property in Italy.

If you have already signed, obtain advice before assuming that discovery of the entry permits withdrawal.

An illustrative purchase near Viterbo

A couple from London finds a house near Viterbo with surrounding land. The property is marketed as full ownership.

A historical extract identifies a livellario and a concedente for one parcel. The seller explains that no payment has been requested for decades and regards the entry as obsolete.

Before offering, the buyers request the relevant earlier instruments and evidence supporting that explanation. The review must also connect the historical parcel with the land now included in the sale.

The buyers do not begin by demanding a particular procedure. They first establish what the reference means and whether a legal issue remains.

The proposed agreement then addresses the evidence and result essential to their purchase, the investigation period and payment consequences.

This is a hypothetical example, not a client case. It does not assume that the entry is enforceable, extinct or readily redeemable.

Send these six document groups before offering

  1. The listing, draft offer and full property identification.
  2. Current and historical cadastral extracts showing the wording.
  3. The seller’s deed and available earlier instruments.
  4. Relevant land-register records and property plans.
  5. Canone receipts, demands and correspondence with the named entity or its successors.
  6. Any claimed redemption, release, recognition or extinction documentation.

Tell us which result the seller promises: transfer of an existing right, full ownership or removal of a specified burden.

How Govoni Law helps

For more than 16 years, our lawyers have assisted foreign property buyers throughout Italy. We act only on the buyer’s side.

We can investigate the documents, identify the legal questions and explain how the findings affect the proposed acquisition. Coordination with the appointed notary, relevant institutions and technical professionals depends on the agreed engagement.

  • Before You Sign Brief: initial orientation on the material supplied. It does not establish extinction, ownership or redemption feasibility.
  • Light Due Diligence: substantive analysis where a genuinely limited legal issue can be scoped responsibly.
  • Full Legal Due Diligence: wider investigation where historical title, parcels and contractual questions interact.

Drafting, negotiation and any separate procedure require an express scope. This page does not offer litigation or promise a particular route to full ownership.

We do not sell or find property, provide tax advice, conduct technical surveys, arrange mortgages or obtain visas. We do not guarantee redemption, regularisation or authorisations.

Frequently asked questions

Does “livellario” prove the seller is not the owner?

Not by itself. It identifies a relationship requiring classification and examination of later events.

Is livello always the same as enfiteusi?

No universal equation should be assumed. The historical arrangement and relevant law must be assessed.

Does a new cadastral extract without the entry settle the issue?

Not necessarily. Establish the legal basis for the changed record.

Does non-payment automatically extinguish the relationship?

No. The underlying right and individual payment obligations must be considered separately.

Can affrancazione always be completed before the sale?

Do not assume that. The nature of the arrangement, parties, evidence and applicable procedure determine what is possible.

Is a property affected by livello necessarily unsuitable?

No. Suitability depends on the established position, the right offered and the buyer’s requirements. An unresolved label should be investigated, not automatically ignored or treated as fatal.

If an Italian deed or cadastral record mentions livello, livellario, concedente or enfiteusi, send Govoni Law the relevant pages, title documents, listing and draft offer before signing or paying. Include any evidence supporting the seller’s claim that the issue has been resolved.

We will do our best to reply to your request as soon as possible.
