Conditions Of Reciprocity about Real Estate Between Italy And Other Countries

These are the conditions of reciprocity between Italy and other countries. The condition of reciprocity consists in the possibility that the foreign citizen who is in Italy can enjoy the same civil rights attributed to the Italian citizen, but this only if the Italian citizen can, in the State from which the foreign citizen comes, enjoy the same rights.

Please note that for those countries with which certain provisions are in force categories of international agreements (reference is made, by way of example, to agreements of regulation of international investments, establishment agreements, treaties friendship, and commerce), the matter of real estate purchases and the incorporation or corporate participation, as far as contemplated therein, is independent of verification of the condition of reciprocity under article 16 of the Preleggi, without prejudice to the exceptions expressly indicated in the individual Country sheets.

ANDORRA (Principality)

REAL ESTATE PURCHASES: The reciprocity condition is not verified. However, it should be noted that the purchase of land of a maximum of 1000 m2 on which to build a house is permitted whose size cannot exceed 33% of the land and that any purchase of a property, building, house, or land must still be authorized by the Government and communicated to the Municipality where the property is located for the payment of local taxes.

ESTABLISHMENT OF/PARTICIPATION IN A COMPANY

The reciprocity condition is verified under the following conditions:

  • 2/3 of the capital must be Andorran or foreigners who have lived in Andorra for over 20 years;
  • the main roles must be attributed to the majority of the capital;
  • the statutes and authorizations must be drawn up only in the Catalan language;
  • the initial capital must be fully subscribed and paid.

Social security contributions are 13% paid by the employer and 5 to 9% by the employer;

The cost of creating a company amounts to approximately 1,230 Euros for Spas, and 100 Euros for LLCs.

There are no direct taxes on business profits, or taxes on individuals.

According to the provisions of Argentine corporate law, citizens and foreigners not resident in Argentina can generally assume corporate positions in a joint-stock company under local law, even if they are not shareholders. For the provinces of British Columbia, New Brunswick, Newfoundland, Nova Scotia, and Ontario the reciprocity condition is verified

For the Province of Alberta, the reciprocity condition for the purchase of land is verified with a maximum total area of 20 acres (approx. 8 hectares);

KYRGYZSTAN

Individual investors:

The reciprocity condition for the purchase of commercial and industrial properties is verified;

regarding the purchase of residential property and land by citizens

foreigners the condition of reciprocity is not formally verified, as it is necessary

an authorization; however, please note that the same is easily granted by demonstrating

that the purchase of the residence is for personal housing purposes.

The reciprocity condition for the purchase of residential properties for the purpose is not met

speculative (the problem can however be overcome with the establishment of a legal company

kyrgyzo, which can also be 100% owned by a foreign citizen);

The reciprocity condition for the purchase of agricultural land is not verified.

Real estate investments by companies:

Investment activities follow different disciplines:

Companies with minority foreign capital (less than 30%): they are equivalent to

local investors. They can purchase land and buildings of any kind. How long

concerns commercial and industrial land, the purchase can be for permanent use or

with 99 year lease. Generally speaking, when you buy from private individuals you don’t need it

of any additional approval beyond the normal permits, to which all are subject

company (registration, notarial deed, land register, building permits, etc.). When

you purchase from public bodies (state, municipality) the limitations (rental for 99 years)

they generally concern the land only, keeping the building area on which it stands separate

the building (in permanent use) from the surrounding area, which is instead rented.

Companies with majority foreign capital:

foreigners can also own 100% of local companies, with the exception of a few

sectors. There are no restrictions on investments, they can purchase buildings (for purposes

residential-civil and industrial) and industrial and residential land (for land the maximum rental period is 49 years). Instead, they need special permissions to

as regards agricultural land, which, however, is not granted for periods

over 49 years of renewable rent.

The condition of reciprocity for the establishment of legal persons is verified, as well

branches and representations.

There are no preclusions to the possibility of holding corporate positions.
